1. Photography Quotes
All fees quoted by Kiren Photography are based on the scope of work and requirements outlined by the client at the time of quotation.
Any subsequent changes to the brief, location, duration, number of subjects, production requirements, deliverables or usage may result in additional charges.
Expenses are estimated in good faith. Where actual expenses differ from the estimate, the actual costs incurred will be invoiced.
Quotes are valid for 30 days unless otherwise stated.
2. Cancellations & Postponements — Business Clients
If a business client cancels or postpones a confirmed shoot, the client is responsible for any expenses incurred by Kiren Photography up to the time of cancellation, including travel, accommodation, location, production and pre-production expenses.
Where a shoot is cancelled or postponed within 48 hours of the scheduled commencement time, the client will also be charged:
50% of the agreed photography fee; and
100% of any confirmed third-party or subcontractor fees that cannot be recovered.
Any rescheduled shoot is subject to photographer availability and may be quoted separately where the scope or requirements have changed.
3. Retainers & Bookings — Private Clients
A 50–100% retainer may be required to secure a specific shoot date. The booking is considered confirmed once the required retainer has been received.
By reserving a date, Kiren Photography declines other potential bookings for that period.
If a private client cancels with less than 48 hours' notice, up to 50% of the agreed photography fee may be retained or charged.
Retainers are applied toward the agreed photography fee and are not transferable to another person or booking unless otherwise agreed in writing.
4. Payment
Private clients are required to pay the full balance by the scheduled shoot date unless otherwise agreed.
Overseas clients may be required to pay a deposit or the full fee in advance.
Established Australian business clients are required to pay within 30 days, as specified on the invoice.
Late payments may incur a $30 monthly administration fee and interest of 2% per month on outstanding amounts, to the extent permitted by law.
5. Day & Half-Day Rates
A full-day rate is based on a maximum of 8 hours, including a 40-minute meal break and a 10-minute break approximately every two hours.
A half-day rate is based on a maximum of 4 hours, including a 10-minute break after approximately two hours.
The allocated time includes photography, location scouting, equipment setup, lighting tests and other production activities required for the assignment.
Additional time may be charged where the agreed shoot duration is exceeded.
6. Turnaround Times
Proof images from assignments of less than half a day are generally delivered via an online gallery within 3 business days of the shoot.
Full-day assignments may require up to 8 business days for delivery.
Turnaround times may vary during periods of unusually high demand or where additional editing, retouching or client approvals are required.
7. Rush Service
A 30% rush surcharge may apply where images or retouching are required within 24 hours.
Rush requests are subject to availability and must be agreed prior to commencement of the work.
8. Usage Definitions
Publicity
Use where photographs are submitted to an external publication, whether print or digital, for editorial purposes and no payment is made for the placement of the photographs.
Advertising
Paid promotional use of photographs in any medium, including newspapers, magazines, websites, digital advertising, billboards and other paid media.
Internal Collateral
Use in materials produced by the client for an audience limited primarily to its employees or internal stakeholders.
External Collateral
Use in materials produced by the client for customers, shareholders, clients or the general public, including annual reports, brochures, magazines, websites and similar publications.
9. Additional Usage
Images may only be used for the purposes and within the media, territory and duration specified in the agreed quotation or licence.
Any additional or extended usage requires prior approval from Kiren Photography and may incur an additional licensing fee.
Commercial use of images by third parties is subject to separate licensing arrangements.
10. Client Approval & Creative Direction
The client is responsible for ensuring that an authorised representative is available during the shoot to approve the photography and creative direction.
Where no authorised representative is present, Kiren Photography's professional judgement and creative interpretation will be accepted as the basis for the assignment.
Kiren Photography undertakes to provide images of a professional standard, within a reasonable timeframe, and to provide appropriate professional direction to subjects where applicable.
The client acknowledges that the final appearance of an image may be influenced by factors outside the photographer's control, including the subject's appearance, expression, energy, preparation and ability to respond to direction.
Kiren Photography cannot guarantee a particular appearance or result where the outcome is materially affected by these factors.
Clients are responsible for final decisions regarding hair, makeup, wardrobe and styling. Kiren Photography may provide professional recommendations where appropriate.
Where hair and makeup artists or other subcontractors are arranged by Kiren Photography, the client may decline their services prior to or at the commencement of the shoot. Once the service has been completed, the associated fee remains payable.
11. Copyright & Licensing
Copyright in all photographs created by Kiren Photography remains with Kiren Photography unless a written copyright assignment or full buy-out has been specifically agreed.
The client's licence to use the images will be defined in the quotation or licence agreement and may specify the permitted media, duration and territory.
The licence becomes effective upon full payment of all outstanding fees.
Any use outside the agreed licence requires prior written approval and may incur additional licensing fees.
Kiren Photography reserves the right to use commissioned images as examples of work, including in portfolios, websites, social media, exhibitions, promotional materials and other print or digital presentations.
Where an identifiable person appears in an image, Kiren Photography will not license or sell that image to third parties for unrelated commercial advertising, stock photography or image libraries without the client's permission, unless otherwise agreed.
12. File Specifications & Delivery
Unless otherwise agreed, proof images are supplied as JPEG files in RGB colour space, optimised for online viewing.
Proof images are individually adjusted for colour, contrast and exposure.
Retouched files are supplied as high-resolution JPEG files in RGB colour space, suitable for standard professional printing and digital use.
Clients requiring alternative file formats, colour profiles or specifications must advise Kiren Photography prior to the shoot. Additional charges may apply.
13. Retouching
Proof files are supplied with general adjustments to colour, contrast and exposure.
Unless specifically included in a package or agreed in writing, hand retouching is not included in the initial photography fee.
Standard hand retouching may include minor skin blemishes, stray hairs and subtle enhancement of the eyes.
More extensive retouching, including significant skin smoothing, reshaping of the body or face, alteration of clothing, removal of objects or complex image manipulation, may incur additional charges.
Retouching orders of 20 images or fewer are generally completed within 3 business days.
A same-day retouching service may be available for an additional 30% rush surcharge, subject to availability.
Where retouching is included in a package, the included retouching must generally be requested within 30 days of proof delivery.
Additional retouching requested after this period may incur a $45 re-order fee, in addition to applicable retouching charges. Turnaround times for orders placed after this period are subject to availability.
For consistency, retouching selections from the same project should be submitted together. Corporate headshot and other large-group retouching orders must be submitted as a single order unless otherwise agreed.
14. File Storage & Archiving
Kiren Photography does not provide permanent file storage or archival services.
Once files have been delivered to the client, responsibility for backing up and securely storing the files rests with the client.
Online galleries may be removed 30 days after delivery without further notice.
Clients are strongly advised to download and maintain multiple independent backups of all delivered files.
15. Acceptance of Terms
By confirming a booking, paying a retainer or proceeding with a photography assignment, the client acknowledges that they have read and accepted these Terms & Conditions.
These Terms & Conditions apply unless otherwise agreed in writing by Kiren Photography.
